Terms of Service

By accessing or using TasteTrail's website, mobile applications, or any related services (collectively, the "Platform"), you confirm that you are at least 18 years of age and agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional guidelines or rules that may be posted on the Platform from time to time. If you do not agree to these Terms, please do not access or use the Platform. TasteTrail reserves the right to modify these Terms at any time. We will notify you of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

TasteTrail is an AI-powered restaurant discovery, booking, and dining ecosystem that connects diners with restaurants. Our services include, but are not limited to: • Restaurant search and discovery powered by artificial intelligence • Table reservation and booking management • Food ordering for dine-in and take-away • Loyalty programs and rewards • Social dining features including reviews, ratings, and shared dining experiences • Private dining and event coordination • Restaurant management tools for restaurant owners and operators • AI-powered dining recommendations ("Palate AI") We reserve the right to modify, suspend, or discontinue any part of our services with or without notice. TasteTrail shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

To access certain features of the Platform, you must create an account. When registering, you agree to: • Provide accurate, current, and complete information • Maintain and promptly update your account information • Keep your password secure and confidential • Accept responsibility for all activities that occur under your account • Notify us immediately of any unauthorised use of your account You may not use another person's account without permission. TasteTrail reserves the right to refuse registration or cancel accounts at our discretion. Your account is non-transferable and may not be sold, traded, or otherwise transferred to another party. Restaurant owners registering their establishments represent and warrant that they have the legal authority to do so and that all submitted information about their business is accurate.

When you make a reservation or booking through TasteTrail: • You enter into a direct agreement with the restaurant. TasteTrail facilitates the booking but is not a party to any dining contract between you and the restaurant. • Cancellation policies vary by restaurant and are displayed at the time of booking. You are responsible for reviewing and adhering to the restaurant's specific cancellation policy. • No-show fees may be charged by restaurants according to their stated policies. TasteTrail is not responsible for any charges incurred. • Booking confirmation is subject to restaurant availability and confirmation. A booking is not confirmed until you receive explicit confirmation from TasteTrail and/or the restaurant. • Group bookings and private events may be subject to separate terms and minimum spend requirements set by individual restaurants. • TasteTrail may charge a booking fee for certain reservation types. Any applicable fees will be clearly disclosed prior to confirmation.

For food orders placed through the Platform: • Prices displayed are set by the restaurants and are subject to change. TasteTrail does not guarantee that prices are accurate at all times. • A service fee and/or applicable taxes may be added to your order total. These will be displayed before you confirm your order. • Payment is processed securely through our payment partners (including Stripe, Ecocash, and PayNow). By providing payment information, you authorise TasteTrail to charge the total amount, including all applicable fees and taxes. • Refunds are subject to the restaurant's refund policy. In cases of disputes, TasteTrail may mediate but is not obligated to issue refunds on behalf of restaurants. • TasteTrail is not responsible for order accuracy, food quality, or any allergic reactions. Allergy information should be confirmed directly with the restaurant. • Orders once placed and confirmed cannot be cancelled unless the restaurant expressly permits cancellation.

Restaurant partners listing their establishments on TasteTrail agree to: • Provide accurate and up-to-date information including menus, hours, pricing, and availability • Honour all bookings and reservations confirmed through the Platform • Maintain a minimum standard of service quality consistent with their listing • Comply with all applicable laws, health and safety regulations, and licensing requirements • Not engage in discriminatory practices against any user • Promptly update TasteTrail of any changes that may affect existing reservations • Respond to customer inquiries and complaints in a timely and professional manner TasteTrail reserves the right to remove or suspend restaurant listings that fail to meet these standards or that receive consistently poor user reviews.

Users may submit reviews, ratings, photos, and other content ("User Content") through the Platform. By submitting User Content, you: • Grant TasteTrail a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, display, and distribute such content in connection with the Platform • Represent that you have the right to submit such content and that it does not infringe any third-party rights • Agree that your review reflects a genuine dining experience at the reviewed establishment • Agree not to submit false, misleading, or defamatory content TasteTrail reserves the right to remove any User Content that violates these Terms or that we deem inappropriate, at our sole discretion. Reviews must be based on genuine personal experiences. Fake reviews, incentivised reviews, or reviews submitted by restaurant owners about their own establishments are strictly prohibited.

You agree not to engage in any of the following prohibited activities: • Using the Platform for any unlawful purpose or in violation of any applicable laws • Impersonating any person or entity or misrepresenting your affiliation with any person or entity • Attempting to gain unauthorised access to any portion of the Platform or its related systems • Using automated means (bots, scrapers, crawlers) to access the Platform without our express written permission • Posting false, misleading, or deceptive content • Harassing, threatening, or intimidating other users or restaurant staff • Attempting to manipulate the review or rating system • Creating multiple accounts for deceptive purposes • Using the Platform to collect or harvest personal data of other users without consent • Transmitting any viruses, malware, or other malicious code

The TasteTrail name, logo, brand identity, and all content on the Platform (excluding User Content) including text, graphics, logos, images, software, and the overall look and feel of the Platform are owned by or licensed to TasteTrail and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial purposes. This licence does not include the right to: • Reproduce, distribute, or publicly display any content from the Platform • Modify or create derivative works based on Platform content • Use any data mining, robots, or similar data gathering tools • Reverse engineer or attempt to extract the source code of our software

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Platform, you consent to the data practices described in our Privacy Policy.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TasteTrail does not warrant that: • The Platform will be uninterrupted, timely, secure, or error-free • The results obtained from the Platform will be accurate or reliable • Any errors in the Platform will be corrected TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TASTETRAIL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM. In no event shall TasteTrail's total liability to you exceed the greater of (a) the amount you paid TasteTrail in the three months preceding the claim, or (b) USD 100.

You agree to indemnify, defend, and hold harmless TasteTrail, its officers, directors, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from: • Your use of the Platform in violation of these Terms • Your User Content • Your violation of any rights of a third party • Any bookings, orders, or transactions you make through the Platform

TasteTrail may terminate or suspend your account and access to the Platform at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms. Upon termination: • Your right to use the Platform will immediately cease • We may delete your account and associated data subject to our data retention policies • All provisions of these Terms that should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability You may terminate your account at any time by contacting us at legal@tastetrail.com or through your account settings.

These Terms shall be governed by and construed in accordance with the laws of Zimbabwe, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, the parties agree to submit to the exclusive jurisdiction of the courts of Harare, Zimbabwe. Nothing in this clause prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.
