Annex A — Diner Terms

In short: These terms apply when you use Taste Trail to find, book or order from a restaurant. Using Taste Trail as a diner is free. Your booking is an agreement with the restaurant, not with us. Deposits, cancellation windows and refunds are set by each restaurant and shown to you before you commit. Always confirm allergen information directly with the restaurant.

This summary is for convenience only and is not part of the agreement. The clauses below govern.

A1. Scope

A1.1 This Annex A applies to you when you use the Platform as a Diner — to search, book, order, review, save venues, join loyalty programmes or use the AI Concierge.

A1.2 It supplements the core Terms of Service. Where this annex conflicts with the core Terms, this annex prevails for Diners.

A1.3 Using Taste Trail as a Diner is free. We do not charge you a booking fee or commission. Optional paid features, if offered, are described at the point of purchase.

A2. Bookings

A2.1 Who your contract is with. When you make a booking, you enter into an agreement with the Restaurant Partner, not with Taste Trail. We transmit and confirm the booking on the restaurant's behalf.

A2.2 Confirmation. A booking is only confirmed when you receive a confirmation from us or the restaurant. A pending request is not a confirmed table.

A2.3 Accuracy. You must give accurate details, including party size, timing and any dietary or accessibility needs.

A2.4 Turning up. Please arrive on time. Restaurants may release a table after a grace period shown at the time of booking, or refuse service if you arrive materially late or with a larger party than booked.

A2.5 Changes and cancellations. Cancel or amend through the Platform as early as you can. The applicable cancellation window and any charge are shown before you confirm the booking.

A2.6 No-shows. Repeatedly failing to attend confirmed bookings without cancelling may result in restrictions on your account or forfeiture of a deposit under A3.

A2.7 Restaurant cancellation. A restaurant may occasionally cancel — for closure, over-booking or an emergency. Where it does, we will notify you and any deposit you paid will be refunded in full. We are not otherwise liable for a restaurant's cancellation, including for wasted travel or consequential loss.

A3. Deposits, Payments & Refunds

A3.1 Some restaurants require a deposit to hold a table. Where they do, the amount, how it is calculated (a fixed amount, an amount per guest, or a percentage) and the conditions are shown before you pay.

A3.2 Free cancellation window. Each restaurant sets a cut-off — commonly 24 hours before the booking. Cancel within that window and your deposit is refunded in full.

A3.3 After the cut-off. Cancel after the cut-off, or fail to attend, and the restaurant may retain some or all of your deposit, as disclosed to you at booking.

A3.4 Refunds. Where a refund is due, we or the restaurant will initiate it to your original payment method. Timing depends on your bank or provider — typically 3–10 business days.

A3.5 Payment methods. We support cards and locally relevant methods including EcoCash, InnBucks and Paynow/Payonify, depending on your market. Payments are handled by third-party providers under their own terms.

A3.6 Currency. Prices are shown in the restaurant's local currency. Your bank may apply a conversion rate or cross-border fee that we do not control.

A3.7 Disputes. Raise any billing issue with us at support@taste-trail.com first. We will investigate and liaise with the restaurant and payment provider. Initiating a chargeback before contacting us may delay resolution.

A3.8 Our role. Where we collect payment, we do so as agent for the Restaurant Partner. This does not make us the supplier of the meal.

A4. Food Orders

A4.1 Where a restaurant offers ordering, your order is an offer to buy which the restaurant may accept or decline.

A4.2 Prices, availability and preparation times are set by the restaurant and may change. If an item becomes unavailable after you order, the restaurant will contact you to substitute, part-refund or cancel.

A4.3 Once a restaurant has begun preparing your order it generally cannot be cancelled. Any right to cancel is set by the restaurant and shown to you.

A4.4 Problems with an order. If your order is wrong, late or unsatisfactory, raise it with the restaurant first — they can usually fix it fastest. If that fails, contact support@taste-trail.com and we will help, though the restaurant remains responsible for the food and its preparation.

A5. Allergies, Dietary Requirements & Food Safety

A5.1 You can record dietary requirements and allergies in your profile, and our recommendation and AI features treat declared allergies as hard constraints — they are never overridden by paid placement or promotion.

A5.2 But you must still check. Menu, ingredient and allergen information is supplied by the Restaurant Partner. We do not verify it and cannot guarantee it. Kitchens change recipes, suppliers and preparation methods, and cross-contamination is possible in any kitchen.

A5.3 If you have a severe allergy or intolerance, you must confirm directly with the restaurant before ordering or eating. Do not rely on the Platform, its filters, or any AI response as your only safeguard.

A5.4 Taste Trail is not liable for allergen or dietary information supplied by a Restaurant Partner, or for any reaction arising from food prepared or served by a restaurant. Nothing in this clause limits liability that cannot lawfully be limited.

A6. Reviews & Ratings

A6.1 Reviews must describe a genuine experience at the venue reviewed. We may require a verified visit before publishing.

A6.2 You must not:

• review a venue you have not visited;

• accept payment, discounts or other benefit in exchange for a review;

• post a review to harm a competitor; or

• include personal information about staff or other diners.

A6.3 Reviews are your opinion, not ours. We do not endorse them and are not responsible for their content.

A6.4 We may remove a review that breaches these Terms. We do not remove a review merely because it is negative or because a restaurant objects.

A6.5 Restaurants may reply publicly to reviews. A reply does not change your rights.

A6.6 Under clause 6.2 of the core Terms, a published review may remain visible after you close your account, though we will disassociate it from your name on request to privacy@taste-trail.com.

A7. Loyalty, Rewards & Referrals

A7.1 We may offer points, tiers, rewards and referral benefits. Any specific promotion may carry additional terms shown at the time.

A7.2 Points have no cash value. They are not property, cannot be sold or transferred, and cannot be exchanged for cash.

A7.3 We may vary earning rates, redemption values and tier thresholds on reasonable notice. Points already earned will be honoured under the terms on which they were earned, or we will offer equivalent value.

A7.4 Points may expire after a period of inactivity, where disclosed to you in advance.

A7.5 We may cancel points or rewards obtained through fraud, error or breach of these Terms.

A7.6 Referrals. Referral rewards apply to genuine new users. Self-referral, creating accounts to farm rewards, or bulk distribution of referral links is a breach of these Terms.

A7.7 If we discontinue a loyalty programme, we will give at least 30 days' notice and a reasonable period to redeem.

A8. Social Features & Communal Dining

A8.1 The Platform includes social features — posts, comments, messaging, group planning and communal-table matching.

A8.2 Meeting people. Where you arrange to dine with people you do not know, you do so at your own risk. We do not screen, vet or background-check users. Take the precautions you would with any meeting arranged online: meet in the venue, tell someone where you are going, and leave if you feel uncomfortable.

A8.3 We are not responsible for the conduct of any user, online or in person.

A8.4 Report concerning behaviour through the in-app reporting tools or to support@taste-trail.com. We take reports seriously and may suspend accounts pending investigation.

A8.5 Do not use messaging to advertise, solicit, harass, or share another person's private information.

A9. Your Information & Restaurants

A9.1 To fulfil a booking or order, we share necessary details with the Restaurant Partner — typically your name, contact details, party size, timing and any special requests or dietary notes you provide.

A9.2 The Restaurant Partner is a separate responsible party for its own use of that information and must comply with POPIA independently. Annex B requires it to do so.

A9.3 A restaurant may keep a guest record including your visit history and notes made by its staff. You can ask a restaurant directly to access or delete that record, or contact privacy@taste-trail.com and we will help you make the request.

A9.4 Marketing from a restaurant requires your consent, which you can withdraw at any time.

A10. Your Consumer Rights

A10.1 If you are a consumer in South Africa, you have rights under the Consumer Protection Act 68 of 2008 that cannot be excluded by these Terms, including rights relating to fair and honest dealing, disclosure, and goods or services of reasonable quality.

A10.2 Nothing in these Terms limits those rights.

A10.3 If you have a complaint we have not resolved, you may refer it to the Consumer Goods and Services Ombud or the National Consumer Commission.

A10.4 For privacy complaints you may approach the Information Regulator (South Africa) (https://inforegulator.org.za).
